1. Seller
The seller is Aleks Svirydzenka, trading as ALEKS SVIRYDZENKA ARTISAN ALEKS COMPANY, ul. Dębogórska 84/62, 84-230 Rumia, Poland, NIP (VAT) PL9462711929, REGON 520542046, entered in the Polish Central Register and Information on Economic Activity (CEIDG). Correspondence address: ul. Sopocka 6, 72-300 Gryfice, Poland. Email: aleks@artisanaleks.com. DARALTUS is a brand of the seller.
2. Scope
These terms govern orders placed through daraltus.store for DARALTUS objects and bespoke work. They apply to consumers and to business customers. Consumers keep all rights granted to them by mandatory law.
3. Products made to order
All objects are handmade only after an order is confirmed, to the specification chosen by the customer (finish, colour, texture, size, setting and upholstery). Product images are design visualisations. Small variations in tone, texture and dimensions (up to ±2%) are a natural feature of handmade mineral-composite work and are not defects.
4. Prices
Prices are given in euro. Prices shown on the website are starting prices for the standard specification and do not include VAT or delivery, unless stated otherwise. The final price, including VAT where applicable, delivery and any options, is stated in the proforma invoice before the contract is concluded.
5. Order request and conclusion of the contract
Sending an order request through the website is free and does not oblige the customer to buy. After receiving the request, the seller contacts the customer, confirms the specification and sends a proforma invoice with the final price, lead time and delivery terms. The contract is concluded when the customer accepts the proforma invoice and pays the deposit.
6. Payment
Payment is made by bank transfer to the seller's company bank account stated on the proforma invoice. Unless agreed otherwise: 50% deposit to start production and 50% after the seller notifies the customer that the object is finished, before dispatch. The seller never asks for payment to any account other than the one on its proforma invoice; in case of doubt, confirm by phone or email before paying.
7. Production and delivery
The lead time stated in the proforma invoice runs from the day the deposit is received. Delivery is made to the address agreed with the customer, in protective crating, insured. Delivery costs are quoted separately. The customer should inspect the delivery and note any visible transport damage in the carrier's documents.
8. Right of withdrawal
Because every object is manufactured to the consumer's specification and clearly personalised, the statutory right of withdrawal from a distance contract does not apply (Article 38(1)(3) of the Polish Consumer Rights Act, Article 16(c) of Directive 2011/83/EU). For this reason, the specification is confirmed in writing before production begins. Up to that moment, the customer may cancel the order request free of charge.
9. Conformity and complaints
The seller is responsible for the conformity of the goods with the contract under the applicable law; for consumers the statutory period is two years from delivery. Complaints may be sent to aleks@artisanaleks.com with a description and photos. The seller replies within 14 days. If the goods are not in conformity, the customer may request repair or replacement, or, under the conditions set by law, a price reduction or termination of the contract.
10. Bespoke work
For bespoke projects, the scope, design stages, price and schedule are agreed individually in writing. Design work may be charged separately; this is always agreed in advance.
11. Personal data
Personal data are processed in accordance with the Privacy policy.
12. Final provisions
Polish law applies, without depriving consumers of the protection of the mandatory provisions of the law of their country of habitual residence. Consumers may use out-of-court complaint and redress procedures, including the help of their local consumer protection authorities.
